PAYMENT AND DELIVERY TERMS

These Regulations are an integral part of the Public Offer Agreement concluded between the Individual Entrepreneur Mych Iryna Igorevna, acting on the basis of the entry on state registration of an individual entrepreneur; number and date of entry in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Formations on state registration 2009860000000000731 dated 07.10.2021 (hereinafter referred to as the “Seller”) and the Buyer, and determine the payment procedure and terms of delivery of goods offered for sale on the Site https://mych-objects.com (hereinafter referred to as the “Site”).

1. PAYMENT PROCEDURE

1.1. Payment for the Goods purchased through the Site is made by the Buyer by non-cash transfer of funds using bank payment cards through the payment service integrated on the Site. https://mych-objects.comThe list of available payment instruments is determined by the functionality of the Site and the terms of cooperation of the Seller with the relevant payment systems.

1.2. In the event of technical errors or inability to make a payment through the Site, the Buyer has the right to contact the Seller via the following communication channels:

– By phone number +380509960023, indicated on the Site https://mych-objects.com   (cost of calls according to the tariffs of the Buyer's operator);

– By email mych.objects@mail.com, indicated on the Site https://mych-objects.com .

1.3. The Seller is not responsible for any commissions or fees that may be charged by the issuing bank of the Buyer's payment card or the payment system for making a payment. The Buyer is responsible for paying such commissions.  

1.4. Payment is considered to be made when the funds are successfully debited from the Buyer's payment account and credited to the Seller's current account.

2. DELIVERY AND PICK-UP CONDITIONS

2.1. Self-pickup of the Goods:

2.1.1. The Buyer has the right to receive the pre-paid Goods independently at the address of the Seller's delivery point: Ukraine, 88000, Zakarpattia region, Residential Complex "SHERVUD", 1 Kvitnevyi Street, within the established working hours, or as agreed by the Parties.

2.1.2. The Goods are issued subject to prior confirmation by the Seller of the readiness of the Order for issue. The notification of readiness is sent to the Buyer by the method chosen by him (phone call, e-mail, etc.).

2.1.3. Orders placed between 6:00 PM Friday and 10:00 AM Monday become available for pickup no earlier than the following Monday. The exact time of delivery to the Buyer will be notified in advance.

2.2. Delivery of Goods by Courier Delivery Service LLC “Nova Poshta”:

2.2.1. The Seller ensures the delivery of the Goods to the branch LLC “New Post” for further delivery of the Goods throughout Ukraine to branches/post offices and to the address specified by the Buyer, in accordance with the current terms and tariffs of this carrier, unless otherwise provided for by these Regulations.

2.2.2. The cost of delivery of the Goods is borne by the Buyer and paid by him directly to the carrier upon receipt of the Goods at the current tariffs of Nova Poshta LLC.

2.2.3. Terms of processing and transferring the Order to Nova Poshta LLC:

– Orders are shipped on business days (Monday – Friday, excluding official holidays).

– The Seller undertakes to transfer the duly executed and paid Order to Nova Poshta LLC within the period agreed with the Buyer.

2.2.4. The shipment identifier (waybill number) is automatically generated by Nova Poshta LLC and sent to the Buyer in the corresponding message. The Buyer is responsible for independently tracking the delivery status of the Order.

3. INSURANCE OF SHIPMENTS BY “NOVA POSHTA” SERVICE

3.1. In order to minimize the risks of damage or loss of the Goods during transportation, all shipments made by Nova Poshta LLC are subject to mandatory insurance for the full cost of the Order paid by the Buyer.

3.2. In the event that the Buyer discovers damage to the packaging or the Goods upon receipt of the shipment, as well as in the event of its loss, the Buyer is obliged to take the following actions:

3.2.1. Immediately contact a representative of the Nova Poshta LLC branch to record the fact of damage or loss.

3.2.2. Together with a representative of Nova Poshta LLC, draw up an appropriate act (claim act) with a detailed description of the identified damage or circumstances of the loss. Drawing up this act is a necessary condition for further consideration of claims and possible compensation from the Delivery Service.

 3.2.3. Within 24 hours from the moment of discovering damage or receiving information about the loss, notify the Seller by email mych.objects@mail.com, indicated on the Site https://mych-objects.com  or by phone number +380509960023 by providing a copy of the drawn up act (if available). 

3.3. The Buyer IS OBLIGED to thoroughly check the integrity of the packaging and the conformity of the contents of the shipment to the Order immediately upon receipt of the Goods at the Nova Poshta LLC branch. In case of damage or non-compliance, the appropriate act must be drawn up before signing the documents on receipt of the shipment. The Seller is not responsible for damage to the Goods discovered by the Buyer after acceptance of the shipment without drawing up the appropriate act.

3.4. The Seller undertakes to provide the Buyer with the necessary assistance in communicating with Nova Poshta LLC in order to resolve issues related to damage or loss of the Order, provided that the Buyer complies with the established incident recording procedure.

4. DELIVERY CONDITIONS FOR INTERNATIONAL ORDERS

4.1. International delivery of Orders is carried out using international courier services.

The specific list of available delivery services is determined by the Parties and depends on the international delivery address.

4.2. The cost of international delivery may be included in the price of the Goods or calculated separately during the Order process, depending on the country of destination, weight and dimensions of the shipment. Information about the cost of delivery is provided to the Buyer before paying for the Order.

4.3. Estimated delivery times for international Orders depend on the geographical location of the destination country and the regulations of the relevant courier service. The Seller is not responsible for delays caused by the customs authorities of the destination country or the courier service.  

4.4. After sending an international Order, the Buyer is sent a tracking number to track the delivery status on the official website of the selected courier service. In case of failure to receive a tracking number, the Buyer must contact the Seller, specifying the Order number.  

 4.5. Due to the military aggression of the Russian Federation against Ukraine, the Seller does not send Orders to the territory of the Russian Federation and the Republic of Belarus.

4.6. When importing international Orders into the territory of the destination country, they may be subject to customs clearance and taxation in accordance with the legislation of that country. The Buyer is fully responsible for paying all customs duties, taxes and other mandatory payments related to the import of the Goods. The Seller is not able to predict the amount of these payments and is not responsible for them. In the event of any questions regarding customs clearance, the Buyer is obliged to independently contact the customs authorities of his country to obtain the necessary information.

5. OTHER CONDITIONS

5.1. All issues arising in connection with the payment and delivery of Goods that are not regulated by these Regulations shall be resolved in accordance with the current legislation of Ukraine.

5.2. The Seller has the right to make changes to these Regulations unilaterally by publishing them on the Site. Changes shall enter into force from the moment of their publication and shall not apply to Orders placed before the date of the changes.

WARRANTY AND RETURN POLICY

These Regulations are an integral part of the Public Offer Agreement concluded between the Individual Entrepreneur Mych Iryna Igorevna, acting on the basis of the entry on state registration of an individual entrepreneur; number and date of entry in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Formations on state registration 2009860000000000731 dated 07.10.2021 (hereinafter referred to as the “Seller”) and the Buyer, and determine the terms of the warranty for goods offered for sale on the Site https://myobjects.com  (hereinafter referred to as the “Site”), as well as the procedure for returning and exchanging such goods. 

1. WARRANTY FOR GOODS

1.1. The Seller guarantees that the quality of the Goods complies with the conditions established by the current legislation of Ukraine and their suitability for the purposes for which goods of this type are usually used.

1.2. Given the specifics of the goods sold (interior items, jewelry, decorative items, blown glass products, a significant part of which may be handmade), minor differences in shape, color, size, texture or other details from the images presented on the Site are not considered defects in the quality of the Goods, but are a sign of its uniqueness and individuality.

1.3. The warranty period for the Goods, if provided by the manufacturer, is specified in the Rules for the use of a specific type of Goods on the Site. In cases where the warranty period is not established by the manufacturer, the warranty conditions provided for by the current legislation of Ukraine apply.

1.4. The Seller is not responsible for defects in the Goods that arose as a result of the Buyer's violation of the rules for the operation, storage or use of the Goods, as well as as a result of mechanical damage that arose after the transfer of the Goods to the Buyer, actions of third parties or force majeure circumstances.

2. BUYER'S RIGHTS REGARDING GOODS OF IMPAIRED QUALITY

2.1. If defects are discovered in the purchased Goods during the warranty period, the Buyer has the right, at his/her choice, to demand from the Seller:

2.1.1. Free elimination of defects in the Goods within a reasonable time.

2.1.2. Proportional reduction in the price of the Goods.

2.1.3. Replacement of the Product with a product of a similar brand (model, article number) of proper quality.

2.1.4. Replacement of the Product with a product of another brand (model, article number) with the corresponding price change.

2.1.5. Termination of the purchase and sale agreement and return of the amount paid for the Goods.

2.2. The Buyer's requirements specified in clause 2.1 of these Regulations shall be considered by the Seller within the time limits established by the current legislation of Ukraine.

2.3. To make claims regarding Goods of inadequate quality, the Buyer is obliged to provide the Seller with a payment document confirming the fact of purchasing the Goods on the Site. https://myobjects.com.

2.4. The Seller has the right to inspect the quality of the Goods and engage an independent expert to determine the cause of the defects. If the inspection or examination establishes that the defects are due to the fault of the Buyer, the latter shall be obliged to reimburse the Seller for the costs of the inspection or examination.

3. BUYER'S RIGHTS REGARDING THE RETURN OF GOODS OF PROPER QUALITY

3.1. In accordance with Article 9 of the Law of Ukraine "On Protection of Consumer Rights", the Buyer has the right, within fourteen (14) days from the date of receipt of the Goods of proper quality, to exchange them for a similar product from the Seller, if the goods do not satisfy him in shape, dimensions, style, color, size or for other reasons cannot be used for their intended purpose.

3.2. Exchange of Goods of proper quality is carried out if the Goods have not been used and if their presentation, consumer properties, seals, labels, as well as the payment document issued to the Buyer together with the sold Goods have been preserved.

3.3. The Buyer does not have the right to exchange (return) Goods of proper quality if the Goods are included in the List of goods of proper quality that are not subject to exchange (return), approved by the Resolution of the Cabinet of Ministers of Ukraine dated March 19, 1994 No. 172 (as amended).

3.4. In the event that there is no similar product for exchange at the time of the Buyer's request, the latter has the right to return the purchased Product of proper quality and receive back the amount paid for it.

3.5. The costs of returning the Goods of proper quality shall be borne by the Buyer.  

4. RETURN AND EXCHANGE PROCEDURE

4.1. To return or exchange the Goods, the Buyer must contact the Seller, informing them of their intention and reasons for return/exchange, using the following communication channels:

– by phone number specified on the Site https://myobjects.com  +380 50 996 00 23 (call costs according to the tariffs of the Buyer's operator);

– to the email address specified on the Site https://myobjects.com mych.objects@mail.com.

4.2. The Buyer is obliged to provide the Seller with:

4.2.1. Application for return/exchange of Goods of the sample established by the Seller (at the request of the Seller).

4.2.2. A copy of the payment document and warranty card confirming the purchase of the Goods on the Site https://myobjects.com;  

4.2.3. Photos of the Goods (in case of defects) or photos of the preserved product appearance (in case of returning the Goods of proper quality).

4.2.4. Return the Goods in full condition, with all seals, labels and original packaging (if any).

4.3. The return of the Goods to the Seller is carried out by postal service or by another method agreed upon between the Parties at the expense of the Buyer (in the case of returning the Goods of proper quality) or at the expense of the Seller (in the case of returning the Goods of improper quality, confirmed by the Seller).

4.4. After receiving the Goods from the Buyer and checking its condition and completeness, the Seller makes a decision on satisfying the Buyer's requirements (exchange, refund, elimination of defects, etc.) in accordance with the terms of these Regulations and the current legislation of Ukraine.

4.5. The Buyer shall be refunded within 14 working days from the date of receipt by the Seller of the returned Goods and the decision to refund the funds, by transferring the relevant amount to the Buyer's bank account from which the payment was made, or by another agreed method. The refund period may be extended due to the specifics of the work of banking institutions.

5. RESPONSIBILITY OF THE PARTIES

5.1. For failure to fulfill or improper fulfillment of their obligations under these Regulations, the Parties shall bear liability as provided for by the current legislation of Ukraine and the Public Offer Agreement.

6. OTHER CONDITIONS

6.1. All issues arising in connection with the warranty, return or exchange of Goods that are not regulated by the Offer Agreement and these Regulations shall be resolved in accordance with the current legislation of Ukraine.

6.2. The Seller has the right to make changes to these Regulations unilaterally by publishing them on the Site. Changes shall enter into force from the moment of their publication and shall not apply to Orders placed before the date of the changes.
